1.2 What CLARA provides
CLARA services provide environmental information about cities (such as wind, air quality, temperature and, in the future, noise) produced by computer simulation combined with measurement data. All modelling and simulation techniques reproduce real physical phenomena with limited precision: results depend on assumptions, boundary conditions and input data. CLARA data are therefore estimates, provided for information. They are not measurements, and they are not a substitute for official warnings, emergency services or professional advice.
1.3 No safety reliance
You must not rely on CLARA data as the sole basis for decisions that could affect health, safety, property or legal compliance. In an emergency, follow the instructions of the competent authorities.
1.4 Intellectual property
The CLARA models, algorithms, methodologies, software, databases, and the content of this website remain the exclusive property of BuildWind srl or its licensors. Except for the rights of use expressly granted below or in a written agreement, no rights are transferred to you.
1.5 Liability
To the extent permitted by law, BuildWind is not liable for indirect or consequential damages arising from the use of, or inability to use, a CLARA service, nor for decisions taken on the basis of the data. For paid services, BuildWind's total liability is limited to the fees paid for the service during the twelve months preceding the event giving rise to the claim. Nothing in these terms excludes liability that cannot be excluded under Belgian law.
1.6 Availability and changes
CLARA services are provided as they are. We may change, suspend or discontinue features, and we may update these terms; the date at the top tells you when they last changed. For paid services, the signed agreement prevails over this page where the two differ.
1.7 Privacy
How we handle personal data is described in the privacy policy.
1.8 Governing law and disputes
These terms are governed by Belgian law. Disputes are first addressed through negotiation; failing that, the courts of Brussels, Belgium are competent, without prejudice to mandatory consumer protection rules that give consumers access to the courts of their own residence.
2. CLARA-app, for citizens
2.1 The service
The CLARA-app is a free smartphone application that shows environmental conditions (maps, forecasts, statistics) and can send location-based alerts. It is currently in open testing (beta): features may change, break or be removed, and data may occasionally be unavailable or inaccurate.
2.2 Your use
- The app is for your personal, non-commercial use.
- Do not scrape, extract or redistribute the data, and do not resell access. For commercial access to the data, use the CLARA API.
- Do not interfere with the service, probe it for vulnerabilities or use it in violation of the law.
- Do not use the app while it would distract you from traffic or from your own safety.
2.3 Alerts are informational
Alerts depend on your device settings, network coverage and the quality of the underlying data. They can be late, wrong or missing. They do not replace official weather warnings or air quality alerts issued by the authorities.
2.4 App stores
Downloads through Google Play, the App Store or TestFlight are additionally subject to the terms of those platforms.
3. CLARA-web, for public administrations
3.1 The service
CLARA-web is a web platform for local administrations and public bodies: city-wide environmental dashboards, historical and forecast layers, and decision support. Access is granted under a written agreement (subscription or pilot) between BuildWind and the administration; that agreement defines the covered area, the modules, the service levels and the pricing, and prevails over this page where the two differ.
3.2 Accounts and authorized users
- Access credentials are for the named users of the subscribing organization and must not be shared outside it.
- The organization is responsible for the use made of its accounts.
3.3 Use of the data
- The organization may use the data and analyses internally, for its public tasks, including in reports and communications that cite CLARA as the source.
- Systematic redistribution of the raw data to third parties, or public re-publication of the data as a service, requires a written agreement.
3.4 Decisions remain yours
CLARA-web supports analysis and planning. Administrative and operational decisions, including emergency measures, remain the sole responsibility of the administration and must follow its own procedures and the applicable law.
4. CLARA API, for businesses
4.1 The service
The CLARA API provides programmatic access to environmental data for integration into your own products and platforms. The technical documentation at clara.city/docs describes the endpoints, coverage and limits. Commercial conditions (tiers, volumes, pricing) are set in your service agreement or order form, which prevails over this page where the two differ.
4.2 API keys
- Keys are issued to your organization and are confidential. You are responsible for the calls made with your keys.
- Do not embed a secret key in client-side code. Report a compromised key to us without delay.
- We may throttle or suspend keys that exceed the agreed limits or endanger the service.
4.3 Use of the data
- You may use the data within your own products and services, for your end users, in accordance with your agreement.
- You may not resell or redistribute the raw data as such, build a competing data service from it, or use it to train models that substitute the CLARA service, unless your agreement says otherwise.
- Attribute the data to CLARA where your agreement requires it.
- If you expose CLARA data to your own users, make clear to them that the data are model estimates provided for information (section 1.2 and 1.3 apply to them too).
4.4 Availability
Target availability and support, where agreed, are defined in your service agreement. Planned maintenance and changes to the API are announced in the changelog.
